GENERAL CONDITIONS AND CONFIDENTIALITY POLICY
TERMS OF USE

- These Terms and Conditions set out the terms and conditions for the use of www.icelandbg.com, hereinafter referred to as “the SITE”, and the terms and conditions for e-commerce conducted through the SITE.
- THESE TERMS AND CONDITIONS ARE:

and
Any natural or legal person who has expressly agreed to these Terms and Conditions and who uses the SITE to place orders for the purchase of goods, hereinafter referred to as USER.
PRODAME:
III. The SELLER shall provide the USER with a catalogue of offers for the purchase of goods, and the USER shall have the opportunity to purchase the goods offered on the SITE by requesting and paying the relevant sales price, subject to the USER’s compliance and strict observance of these Terms and Conditions, as well as the additional requirements set out on the respective goods.
ACCEPTANCE OF GENERAL CONDITIONS:
- By ticking the box “I have read the General Terms and Conditions and I agree to them!” and clicking the “Confirm” button, the USER makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that he/she is aware
CHANGES TO GENERAL CONDITIONS:
- (1) These Terms and Conditions may be modified unilaterally by the SELLER.
- When making changes to the Terms and Conditions, the SELLER shall prominently display on the SITE a reference (link) through which the amended Terms and Conditions are accessible.
- The amendments to the General Terms and Conditions shall not affect the relationship between the USER and the SELLER arising in connection with a validly submitted purchase order prior to the notification under (2).
CATALOGUE OF GOODS:
- (1) The individual types of goods are arranged in the form of offers according to various indicators, according to the requirements of the USER and the classification offered on the site.
- Offers contain basic information about the offered product, according to its type and indication of its price. Offers are accompanied by photographs.
- The price indicated for the individual goods is per unit.
- Additional terms of ordering and delivery of products are specified on the site.
PURCHASE REQUEST AND DELIVERY OF GOODS:
VII. (1) Purchase and delivery of goods shall be requested by filling in the purchase and delivery request forms provided on the SITE.
- The USER is obliged to provide accurate details of the person who will receive the goods, as well as the place of delivery.
- The order shall automatically describe, the type, quantity and exact final price (including VAT) of the goods ordered.
- The ordering of a particular product is done by clicking on the ADD TO CART button and subsequently BUY, in the offer of the desired product, by which the USER explicitly confirms his request and agrees to the General Terms and Conditions published on the site, by checking the box labeled “I have read the General Terms and Conditions and agree to them!” and clicking on the “Confirm” button. This action constitutes a declaration of intent which binds the USER and the SELLER with the force of a contract, respectively to the terms described in this document and the rules of the Consumer Protection Act (CPA). Once an order has been placed and confirmed by the USER, the USER will receive an automatic confirmation email from the SITE that the order has been accepted and to expect a second email with delivery details.
- After receipt of the order, the SELLER shall contact the USER via email within 24 hours to confirm the order or the unavailability of an item on the order via the second email described in VII (4). Orders placed on official non-working days (Saturdays, Sundays, public holidays) are processed on the first working day thereafter. The deadline for receipt of the emails confirming the availability of the desired products is then within 48 hours of the first working day.
- In a period of sale/discount of the items from the online store, the SELLER is obliged to send the requested items from an order only if they are in stock. If an item or a number of items are out of stock, the SELLER must contact the USER by e-mail within 48 hours to inform him of the missing items from his order.
- During a sale/discount period, the WEBSITE database is updated by 12.00 noon on the next working day and misleading information may be presented regarding the availability of specific items and their colours/sizes until updated.
- If an order is placed for more than one item, it is possible that an unavailable item may be detected during order processing. In this case, the SELLER will notify the USER via e-mail expecting a confirmation message back for the available items. In the absence of a reply, within 24 hours, the order is fulfilled by sending only the available items.
- In the event of a technical error in the price list of the goods offered, the SITE reserves the right to cancel the orders placed.
- The SELLER shall endeavour to meet all the needs of the USER, but reserves the right to correct any incorrect price or description of any product, and to cancel or refuse any orders placed for any item where the price or description is incorrect. All such corrections may be made even after the order has been accepted. If an inaccuracy is found, the SELLER sends an email notifying the USER. In the absence of a response from the USER to confirm the order, with the already corrected amount or description, within 24 hours, the order is considered cancelled.
- During a discount period, the USER may not refuse an order if it is missing items for which he/she has been previously notified that they are not available due to out of stock. The SELLER will only send the order with items available at the time the order is placed.
- There may be differences in prices, availability and products on the SITE and in the SELLER’s stores.
- Customer Service Representatives may need some personal information such as name, order number or phone number to answer any questions. These details are used so that the response can be as complete and circumstantial as possible.
- When registering, the USER undertakes to provide information about himself that is true, accurate and complete. If the USER changes the details of his/her profile, the USER must immediately send an email to : service@icelandbg.com
DELIVERY TERMS:
VIII. Delivery of the ordered goods shall be made on the following terms:
- The ordered goods shall be delivered to the address specified by the customer. The CUSTOMER undertakes to provide access and the possibility of receiving the goods.
- The goods ordered by the CLIENT shall be delivered within 3 (three) working days /within a reduction period of up to 5 (five) working days/ for the territory of Bulgaria and within 5 (five) working days /within a reduction period of up to 7 (seven) working days/ for the rest of the countries to the address indicated by the CLIENT, provided that the order is confirmed by the CLIENT and the delivery address is indicated accurately and is valid.
- The ordered goods shall be delivered suitably packaged according to their type and the transport used for delivery.
- If the CUSTOMER is not found within the delivery period at the address indicated or access and conditions for delivery of the goods are not provided within this period, the order shall be deemed cancelled and the SELLER shall be released from its obligation to perform the requested delivery.
- In the event that the USER confirms his/her wish to receive the ordered goods and after the expiry of the delivery period in which he/she was not found at the address, he/she shall bear the costs of the additional delivery at his/her own expense. The cost of the second delivery shall be paid upon receipt of the goods, together with the total amount of the order and the first delivery.
- If a third party undertakes to accept and acknowledge receipt of the goods ordered on behalf of the original USER who placed the order, the latter shall not be entitled to return the goods or to make any objection to the delivery.
- Delivery for the territory of Bulgaria, Greece, Macedonia, Serbia. Romania and the European part of Turkey is free of charge. For the other countries, delivery is only possible with a minimum value of the ordered goods of 1600 / one thousand six hundred / leva, in which case delivery is also free.
CONDITIONS FOR CANCELLATION AND RETURN OF GOODS:
- (1) A CONSUMER who has ordered goods from the SITE shall be entitled to refuse receipt of any goods ordered by him/her when they are delivered to him/her only in the circumstances set out in these terms and conditions:
– If the goods delivered clearly do not correspond to those ordered by the USER and this can be established by a simple examination of the goods;
– If the goods or their packaging are damaged in transit;
– If the price to be paid by the USER does not correspond to the price originally quoted on the SITE;
– If the time limit stated for delivery is not met;
- Claims under the above points are made only at the time of delivery.
- Except in the cases listed, the CUSTOMER shall not be entitled to refuse to receive and pay for the goods ordered. Otherwise, he/she shall be liable to pay the costs incurred for delivery and return of the goods.
- For cases of refusal to receive the goods, a report shall be drawn up at the time of delivery. If the CUSTOMER refuses to sign the protocol, it is assumed that his refusal to receive the goods is unjustified and he is liable to pay the costs of delivery and return of the goods.
XII. After receipt and payment of the goods, the USER may make a claim and request their return and refund of the price paid by him in the following cases:
- If the goods have a material defect or non-conformity which could not have been detected by ordinary examination of the goods;
- If the goods are materially defective in use so as to render them unfit for their intended purpose;
- Without giving a reason for returning the product if it is in its original form, packaging and quality.
RECOMMENDATIONS ARE ACCEPTED AS FOLLOWS:
XIII.
- For item (1)and (2) of XII : within 24 hours of receipt of goods.
- Under clause (3) of XII : under the Consumer Protection Act, Article 55, the CONSUMER shall have the right, without compensation or penalty and without assigning any reason, to withdraw from the goods purchased within 14/ fourteen/ working days from the date of receipt of the goods.
The SELLER shall refund the USER in full the amount paid by the USER, no later than 14 /fourteen/ working days from the date on which the USER has submitted the cancellation by bank transfer or courier, the costs of which shall be borne by the USER.
XIV. (1)When returning an item for an exchange or refund, the USER shall send with the item, the following documents:
a receipt, a copy of the invoice, with the following fields filled in:
– Refund: the product he wishes to return, reason for return, IBAN account number;
– Exchange for size or other item: by specifying the ID Number name of the item, size and color desired.
- In the absence of any of the above documents, the SELLER reserves the right to refuse a REFUND and/or exchange.
- Returns of items shall be made by courier company only, at the option and expense of the USER.
- Transportation costs for the return of the purchase are at the expense of the USER.
For an item to be returned, it must be in good merchantable condition:
– the goods have not been used;
– its packaging is intact;
– the receipt and invoice are intact.
- If there is a discrepancy between the goods ordered and the goods delivered, which could not be ascertained at the time of delivery, the goods shall be replaced after the CUSTOMER’s request and inspection to ascertain the discrepancy.
XVI. In case the USER wishes to exchange an item purchased from the WEBSITE for a size or other goods, it shall be sent back by courier to the address : Sofia 1000, ul. Vitosha 80, ground floor, at the expense of the USER, only on condition that the goods are not used, the packaging and the receipt are preserved. The exchanged amount of the purchased item(s), respectively, shall be sent back to the USER at the indicated delivery address, at the expense of the SITE.
XVII. In the event of five refusals to accept an order registered by the USER’s account, address or name, the SELLER reserves the right to refuse the execution of a subsequent order.
XVIII. When returning an item purchased from the SITE, it is necessary for the USER to adhere to these terms and conditions XII (3). The SELLER refuses to accept items sent for refund with the “Cash on Delivery” option.
METHOD OF PAYMENT:
XIX. Payment for ordered goods shall be made in the following ways:
- A cash on delivery – only for the territory of Bulgaria: The payment of the product you have chosen is made at the time of delivery, the corresponding amount being handed over to the courier.
- By card : Payment is made by credit/debit card through the EPAY electronic payment system, through an ATM or in cash at EPAY offices.
PRIVACY AND PRIVACY POLICY
- Aisland BG Ltd with UIC: 202860680, as the owner and administrator of the Siteicelandbg.com respects the right of users to be informed about the collection, use and storage of their personal data. For this reason, this policy explains how we process the information provided to us by users of this Site.
The Seller Eisland BG Ltd is a data controller registered under the DPA and bound by its provisions in full. We comply with the Data Protection Act and use numerous technical and organisational means to protect your data from misuse, damage, loss or unauthorised access. We do not provide your personal data to third parties without your express consent in any form.
We will only use your personal data with your permission, for the purpose of better service, and the use of your personal data is minimized and will not exceed the purposes for which it was collected and processed.
The user gives his/her express consent for the personal data provided by him/her to be collected, stored, processed and used by the Seller and/or persons authorized by the Seller, including but not limited to: the company
1. Purposes for the collection of personal data.
The collection, storage and processing of personal data is done for the purpose of the performance of the distance selling contract and the delivery of the ordered goods.
In order to deliver the product you are looking for and to process the sale, we must have information including your personal data: your delivery address, your telephone number for order confirmation and contact possibility, your name for the purpose of processing the sales contract, your e-mail address and, if necessary, your bank account number.
Data related to confidential financial information – debit and credit card numbers are not processed and stored by the Site administrator, but by the bank servicing the transactions. When a customer returns goods, the customer will be required to provide a bank account number to which the amount paid for the goods will be credited back. With the user’s explicit voluntary consent, Eisland BG Ltd will have the right to process the personal data of users for marketing purposes, such as sending users – via e-mail, SMS, etc. information about , offers, promotional campaigns and other similar initiatives.
No personal data is collected and processed when unregistered users visit the website.
- Provision and disclosure of personal data.
The provision of personal data by the customer is necessary for the performance of the services and functionalities offered by the Site and required by the user, such as registering on the Site and purchasing a desired product, subscribing to newsletters or receiving other news published on the Site, or other initiatives offered through the Site or other promotions on behalf of Eisland BG Ltd. - Storage of personal data.
Personal data will be collected and Site , managed by Eisland BG Ltd and stored in an electronic system of the company. The site administrator declares that personal data will not be provided outside Bulgaria. The storage period of personal data is determined by the duration of the user profile. As long as the user has a valid, active profile on the site, the administrator stores his personal data. At the time of deletion, deactivation of the profile , the personal data information will be deleted or anonymized in compliance with the current legal requirements in this regard, within one month.
Your personal data will not be disclosed to third parties, except for the purpose of delivery of the products you have purchased or to persons authorized or authorized by you.
- Personal data processing.
Eisland BG Ltd, as the administrator of the website processes personal data of users within the scope and under the circumstances set out in this Privacy Policy and in accordance with the consent given by the user when collecting data.
The user’s personal data will be processed within the organisation of Eisland BG Ltd by authorised persons who will have access to it on the basis of their duties and in relation to the purposes of the processing .
This policy forms part of the Terms of Use of this website and as such is to be applied and interpreted in accordance with the laws of the Republic of Bulgaria.

XXI. (1) The USER is entitled to freely use the resources of the SITE, except for the restrictions described in these General Terms and Conditions and other generally applicable restrictions.
- SITE USER may not copy or distribute content!
